        In certain instances, marijuana possession can be a crime.  The crime is known as Criminal Possession of Marijuana and it carries far more serious consequences than Unlawful Possession of Marijuana.  

         The following acts constitute Criminal Possession of Marijuana: 

    1.  Possession in a public place of any amount of marijuana which is burning or open to public view.

    2.  Possession of two or more ounces of marijuana. 

        Criminal Possession of Marijuana is classified as a misdemeanor in most cases, but it can be classified as a felony.  If you are charged with possessing between two and eight ounces (approximately) of marijuana, you are facing a misdemeanor.  If you are accused of burning marijuana in public, you are also facing a misdemeanor.  Misdemeanors are serious.  However, it is unlikely that you will do jail time (unless you have a lengthy criminal history).  If you are charged with Criminal Possession of Marijuana, you will likely receive probation and/or a fine.
